Cabinet approves justifications for amending real estate ownership law

Amman, February 4 (Petra) – The Cabinet approved on Tuesday the justifications for the draft amendment to the Real Estate Ownership Law of 2026 and referred it to the Legislation and Opinion Bureau to complete the legal procedures.

The draft amendment aims to address issues related to joint ownership by simplifying and accelerating procedures, a step expected to resolve long-standing disputes involving thousands of properties and bring idle real estate assets into the economic cycle.

The proposed amendments allow for electronic sales, electronic signatures and the full digitisation of real estate procedures and transactions, including payment, subdivision and sale, in accordance with the Notary Public Law.

This shift is intended to reduce financial and administrative burdens, facilitate services and save time and effort.

The draft law permits the sale and subdivision of land off-plan prior to construction, subject to the issuance of an allocation certificate approved by a bank, a move aimed at encouraging investment and real estate development.

Under the amendments, the requirement for unanimous consent among partners to divide properties with existing buildings is replaced with the approval of owners representing three-quarters of the property, without infringing on the rights of remaining partners.

The draft obligates the government, municipalities and the Greater Amman Municipality (GAM) to compensate for expropriated land within a maximum of five years, with financial penalties imposed for delays.

It resolves legislative overlaps related to the removal of joint ownership and agricultural units, aligning its provisions with the Jordan Valley Development Law to prevent duplication.

The amendments seek to streamline procedures by delegating authority to directors in governorates and regions, reducing centralisation.

The proposed changes are expected to enhance legislative stability, strengthen confidence in the real estate sector and support the objectives of the Economic Modernisation Vision.
