Justice Minister: Judicial Expertise By-Law Enters into Force to Modernize Litigation

AMMAN, Nov. 4 (Petra) – The entry into force of the Judicial Expertise By-Law represents a pivotal structural advancement in modernizing litigation procedures and establishing an integrated institutional framework for forensic expertise, Minister of Justice Bassam Al-Talhouni affirmed Wednesday.

In a press statement issued by the Ministry of Justice, Al-Talhouni stated that the new legislation forms part of ongoing ministerial efforts to reform the judicial environment, enhance procedural transparency, shorten litigation cycles, and bolster public confidence in court rulings.

The By-Law introduces new institutional mechanisms within the judicial branch, chief among which is the establishment of a specialized Judicial Expertise Directorate across courts. This administrative unit will oversee operational and technical procedures, standardizing workflows and expediting case processing.

Under the new regulations, forensic expertise before judicial authorities is restricted exclusively to certified, sworn experts registered with the ministry. Candidates must undergo technical examinations and interviews for specialized disciplines, with mandatory annual license renewals to ensure continuous professional qualification.

In line with the Kingdom's digital transformation agenda, the By-Law integrates an automated electronic platform governing expert-related procedures. The system digitizes expert registration, court assignment, performance evaluation, electronic notifications, and complaint filings, eliminating paper-based administration.

Al-Talhouni added that certified expert rosters will be published transparently on the Ministry of Justice website, with electronic registry records granted full legal admissibility.

To safeguard judicial impartiality, the By-Law institutes a randomized rotational assignment mechanism for expert selection and creates a centralized account to manage fee collections and disbursements.

Addressing oversight and accountability, Al-Talhouni noted that the By-Law establishes dedicated evaluation committees to process performance appeals, introducing a progressive disciplinary scale ranging from formal warnings to temporary suspensions and permanent registry expulsions. It strictly prohibits direct ex parte communication between experts and litigants outside designated legal channels.

To facilitate compliance, the ministry has published operational manuals and instructional media for legal practitioners and certified experts.
